Article 1 : GENERAL
CONDITIONS
The general conditions of sale listed hereafter are applicable
to all orders placed with "Le Bouquet Nantais".
All contrary conditions put forward by the client without written
acceptation are inapplicable to the seller regardless of the moment
at which they are brought to his attention.
The fact that the seller does not exercise one or the general
conditions of sale presented here at a given moment cannot be taken
to mean that he forgoes the right to exercise one of the
aforementioned conditions at a later date.
Article 2 : The order
All information supplied by the client at the time of ordering is
taken as binding.
The seller cannot be held responsible for failure to deliver the
floral arrangement if the address or delivery details supplied by
the client are false.
Orders are not considered to be definitive until the full price has
been paid by the client.
Product offers are only valid while stocks last.
Bouquets may differ from the photos shown on the Web site depending
on the flowers available in season. No refunds shall be given in the
event of orders for fresh flowers subsequently cancelled by the
purchaser.
All orders can be registered for a minimum amount of 22.87 €,
delivery costs included.
Throughout the year, Bouquet Nantais offers you a selection of
bouquets specially made for any type of holidays.
Article 3 : DELIVERY
Delivery is made upon receiption of payment.
You can consult the orders hour for an overnight delivery on the
Chronopost et
Fedex
websites.
If the day choosen for the delivery is not in accordance with the
delivery company's conditions, Bouquet Nantais will inform the buyer
and its order will be on hold until this buyer takes a decision
concerning the delivery date.
Delivery prices by bouquet : France : 9,80 €, Europe :
27,00 €, USA : 27,00 €.
Important :
Be sure the delivery address is correct.
Be sure the addressee will be there for the delivery.
The addressee will not be contacted by the delivery man before the
delivery
- if the adressee is away, the delivery man will put a notice in his
letter box.
The addressee will have to go and pick up the product within 24
hours as the product is perishable.
Delivery time are indicated as exactly as possible.
A longer delivery time cannot give rise to damages.
If the delivery address is not good, Bouquet Nantais cannot be
responsible if the order cannot be delivered.
However, if the product has not been delivered to the recipient on the expected day of delivery, the delivery society will put a note in the mail box (if the mail box
is accessible and identifiable). Without notice of passage, for any case expect cause
beyond control, the sale can be cancel and the buyer will be able to
be paid back or to order another bouquet. There will not be any
further damages.
Are considered as cause beyond control which discharge the saler of
its delivery obligation, war, fire, strikes, riots, accidents or
impossibility of being supplied. The saler will inform the buyer in
case of cause beyond control.
The delivery in time is only possible if the buyer has discharged
his commitments towards the saler.
Article 4 : GUARANTEE
Complaints concerning the delivered product must be, as it is fresh
products, made within 5 days after the product's delivery. No
damages can be asked by the buyer or the addressee apart from Paid
back or Replaced.
Article 5 : PRODUCT'S RETURN
Every return must be the subject of a formal agreement between the
saler and the buyer.
Article 6 : PRICE
Products are presented with prices in force at the time of the order.
If a technical problem came at the time of the order and if the
price was not respected, the order will be put aside until the
problem is settled.
The price payment is made cash at the time of the order.
Article 7 : LAWSUIT
Objections or contestings will always be received with attention, good
faith being always presumed for those who explains his situation. In
case of lawsuit, the buyer will at first inform the company in order
to try to find an amicable solution.
If there is no agreement, only court will be competent.
